REGISTRATION OF YOUR FOREIGN DIVORCE IN SOUTH AFRICA
PLEASE SUBMIT YOUR APPLICATION BY POST
To enable this office to register your divorce in South Africa please download and complete the form “REGISTRATION OF DIVORCE”- CMO3 and submit together with:
- Your APOSTILLE/ legalized divorce certificate.

Please Note: Apostille Certification can be obtained only from Foreign, Commonwealth and Development Affairs.
Once you get the document Apostilled/legalised, submit 2 x Certified copies of your legalised document (make copies on both the sides).
- If the divorce certificate is not in English, an Apostille copy of the foreign divorce certificate accompanied by an English translation by a sworn translator is required.
- Two certified copies of your passport and ID document and your ex-wife/husband’s passport and ID document
Current legislation stipulates that female married/divorced applicants may elect to use their married surname/their maiden surname or a combination of both current married surname and maiden surname i.e. double-barrel surname, without having to formally apply for change of surname.
Person’s whose surnames have changed, may apply for a passport and/or identity document, reflecting the married/maiden surname by submitting a letter confirming that she wants her passport/ID document to be issued in her chosen surname.
PLEASE NOTE:
- There is no application fee for the registration of a divorce with the Department of Home Affairs.
- No divorce certificate can be issued from RSA.
- The Purpose of the registration is to change your status on the national population register which is compulsory.
- Please Note: Incomplete application will not be processed.
